1 TERMS & CONDITIONS (Terms of Service)

1.1 Introduction

Welcome to Ask Bestie (“Ask Bestie,” “we,” “our,” or “us”). These Terms & Conditions (“Terms”) govern your access to and use of the Ask Bestie website, mobile apps, APIs, and any related services (collectively, the “Service”). By creating an account or otherwise using the Service you agree to these Terms, the integrated Privacy Policy (section 2) and the Refund & Cancellation Policy (section 3).

1.2 Definitions

Term Meaning
User / you Any individual or entity that accesses or uses the Service.
Credits Internal units that can be exchanged for one word, one image, one voice conversion, or ~one video frame.
Content Text, images, audio, video, or other material generated, uploaded, or stored through the Service.
Subscription A recurring paid plan that grants a monthly allowance of Credits and feature access.
Payment Processor The independent third-party provider that securely processes all card or wallet payments for us.

1.3 Eligibility

You must be at least 18 years old (or the age of digital consent in your region) and able to form a binding contract. If you act for an organisation, you confirm that you have the authority to bind it.

1.4 Account & Security

You agree to: (a) provide true, current information; (b) keep your password confidential; (c) accept responsibility for all activity on your account, including actions by invited team members.

1.5 Our Service

The platform aggregates multiple third-party AI models (e.g., GPT-4 o, Claude 3 Opus, Gemini 1.5 Pro) so you can generate or analyse Content from one dashboard. Model outputs are probabilistic and may be inaccurate, unlawful, or unfit for purpose; you alone are responsible for verifying and using any generated Content.

1.6 Intellectual Property

  • Our IP – All software, templates, and branding belong to Social Mania (Pty) Ltd.

  • Your IP – Subject to model-specific terms and applicable law, you own the inputs you supply and the AI outputs you receive.

  • Feedback licence – You grant us a perpetual, royalty-free licence to use feedback for product improvement.

1.7 Acceptable Use

You will not:

  1. Violate any law or regulation.

  2. Generate, upload, or share content that is illegal, harmful, defamatory, or infringing.

  3. Reverse-engineer, scrape, or disrupt the Service.

  4. Sell, lease, or share your account or Credits outside Ask Bestie.

1.8 Billing, Taxes & Renewals

All prices are in US dollars unless otherwise noted. Subscriptions renew automatically at the end of each billing period unless cancelled in advance. Local taxes (VAT/GST, etc.) are added where required.

1.9 Credits & Overage

Credits have no monetary value and expire at the end of the billing cycle unless a plan specifically allows roll-over. If you exceed your allowance we may (a) bill overage at the posted rate, or (b) throttle usage until the next cycle.

1.10 Free Trials

Trials convert to paid Subscriptions at the listed price unless you cancel before the trial ends.

1.11 Termination

You may cancel at any time from the dashboard; access continues until the current paid period ends. We may suspend or terminate accounts for breach, security risk, or non-payment.

1.12 Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES—EXPRESS OR IMPLIED—including MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

1.13 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SOCIAL MANIA (PTY) LTD, ITS DIRECTORS, EMPLOYEES, AND SUPPLIERS SHALL NOT BE LIABLE FOR INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR AGGREGATE LIABILITY IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

1.14 Indemnity

You will indemnify and hold harmless Social Mania (Pty) Ltd from claims arising out of your Content, your use of the Service, or your breach of these Terms.

1.15 Changes to Terms

We may update these Terms from time to time. Material changes will be announced by e-mail or in-app notice. Continued use after the effective date constitutes acceptance.

1.16 Governing Law & Disputes

These Terms are governed by the laws of the Republic of South Africa. Exclusive jurisdiction lies with the courts of the courts of Johannesburg, Gauteng (including the High Court of South Africa, Gauteng Local Division), unless a mandatory consumer law in your country specifies otherwise.

2 PRIVACY POLICY

2.1 Data We Collect

2.2 How We Use Data

2.4 Sharing & Disclosure

We share data only with trusted infrastructure providers and the Payment Processor. We never sell personal data.

2.5 International Transfers

Data may be processed outside your country with appropriate safeguards (e.g., Standard Contractual Clauses).

2.6 Retention

Account data is kept while the account is active and for 24 months thereafter unless a longer retention is required by law.

2.7 Security

TLS 1.2+, bcrypt-hashed passwords, role-based access controls, annual penetration tests.

2.8 Your Rights

Subject to local law you may request access, correction, deletion, or portability of your personal data, or object to processing. Contact support@askbestie.com.

2.9 Cookies

Essential cookies keep you logged in; optional analytics cookies are disclosed in the banner and can be declined.

2.10 Children

The Service is not directed to children under 13 (or under 16 in the EU). We do not knowingly collect their data.

2.11 Policy Updates

Material Privacy Policy changes will be announced by e-mail or banner notice.


3 REFUND & CANCELLATION POLICY

  1. Self-service cancellation
    Cancel anytime in the Billing tab. Access continues until the current paid period ends.

  2. 14-day satisfaction guarantee
    If you are unhappy, e-mail support@askbestie.com within 14 days of the initial purchase or renewal. We will refund the unused portion of your Credits (less any non-refundable payment-processor fees).

  3. Credit packs & Lifetime plans
    These are non-refundable once delivered, because Credits are provisioned instantly.

  4. Chargebacks
    Please contact us first. Unauthorised chargebacks may result in account suspension.

  5. Policy violations
    Accounts terminated for breaching the Acceptable Use Policy are not eligible for refunds.

  6. Processing time
    Approved refunds are sent back to the original payment method within 5-10 business days.
